Membership Terms & Conditions

These Membership Terms & Conditions ("Membership Terms") govern your purchase and use of a paid 108 Membership ("Membership"). They are in addition to, and incorporate by reference, our general Terms of Service and Privacy Policy. By subscribing to a Membership you agree to these Membership Terms. If you do not agree, do not subscribe.
1. The Membership
A 108 Membership is a paid, auto-renewing subscription that unlocks member benefits described on the Membership page, which currently include: access to exclusive items not listed in the store; one (1) entry into our monthly prize pool for each month your Membership is active; VIP early access to new features; and a 108 Members Badge. Additional benefits (such as member-only drop boxes) may be introduced over time. We may add, change, or remove benefits with reasonable notice; we will not materially reduce the core benefits without notifying active members.
2. Eligibility & Availability
You must be at least 18 years of age and have the legal capacity to enter into a binding contract to purchase a Membership. You must provide a valid email address and a valid payment method. The Membership is intended for residents of Australia.
Availability restrictions: the monthly prize draw associated with the Membership (see clause 8) is a trade promotion that is regulated differently across Australian states and territories. The prize draw is void where prohibited and may be unavailable, or subject to additional conditions, in certain states or territories, for example, where the draw would require a permit or authorisation that we do not hold. We reserve the right to exclude residents of any jurisdiction from the prize draw, or to vary or withdraw the prize draw in any jurisdiction, where necessary to comply with applicable law. Where the prize draw is unavailable in your jurisdiction, all other Membership benefits continue to apply.
3. Billing & Auto-Renewal
The Membership is billed monthly in advance at the price shown at checkout (currently A$20.00 per month, in Australian dollars and inclusive of GST where applicable). Your Membership renews automatically every month and your payment method is charged on each renewal date until you cancel. By subscribing, you authorise 108 Dev Co and our payment processor to charge the recurring fee plus any applicable taxes to your payment method on each renewal date.
4. Payments & Processor
Payments are processed securely by Stripe. We do not store your full card details. Your use of Stripe is also subject to Stripe's terms and privacy policy. You are responsible for keeping your payment information current; failed payments may result in suspension or cancellation of your Membership.
5. Price Changes
We may change the Membership price. We will give you at least 30 days' notice by email before a price change takes effect. The new price applies from your next renewal after the notice period. If you do not agree to the new price, you may cancel before it takes effect.
6. Cancellation
You may cancel your Membership at any time through the billing portal linked on the Membership page. When you cancel, your Membership remains active until the end of the current paid billing period, after which it will not renew and member benefits will end. We do not provide partial-month refunds for cancellations except where required by law.
7. Refunds
Except where required by applicable consumer law, Membership fees are non-refundable, including for periods in which you did not use member benefits. Australian users retain all rights under the Australian Consumer Law that cannot be excluded by contract.
8. Monthly Prize Pool
Active members receive one (1) entry into the monthly prize pool for each calendar month in which their Membership is active. Prize-pool entries have no cash value, are non-transferable, and expire if your Membership lapses. Specific prizes, eligibility, draw dates, and winner-selection methods are determined by 108 Dev Co and may vary month to month. Where a prize promotion is subject to separate official rules or local prize-draw/lottery regulations, those rules also apply.
Australian availability: the monthly prize draw is a trade promotion regulated under the laws of individual Australian states and territories. It is void where prohibited and may be unavailable, restricted, or subject to additional conditions (including permit or authorisation requirements) in certain states or territories. We reserve the right to exclude entrants from, or to vary or withdraw the prize draw in, any jurisdiction where it would otherwise be unlawful or where we do not hold a required permit. No purchase or paid Membership is necessary to enter the monthly prize draw. A free method of entry is available to everyone, set out in clause 16.
9. Exclusive Items & Member Drop Boxes
Exclusive items and (when available) member drop boxes are offered subject to availability and may be limited in quantity. They may be sold at additional cost, may differ from images shown, and may be added, changed, or withdrawn at any time. Member-only availability is a benefit of an active Membership and ends when your Membership ends.
10. Members Badge
The 108 Members Badge is a non-transferable benefit tied to an active Membership and may be removed if your Membership ends. Any future utility associated with the badge is provided at 108 Dev Co's discretion and is not guaranteed.
11. Acceptable Use
You agree not to misuse member benefits, including reselling exclusive items obtained through your Membership, creating multiple accounts to gain additional prize-pool entries, or otherwise abusing the program. We may suspend or terminate a Membership for breach of these Membership Terms or our Terms of Service, without refund where permitted by law.
12. Termination by Us
We may suspend or terminate your Membership for non-payment, breach of these Membership Terms, or if we discontinue the Membership program. If we discontinue the program, we will provide reasonable notice and will not charge you for periods after the program ends.
13. Disclaimers & Liability
MEMBERSHIP BENEFITS ARE PROVIDED "AS IS" AND "AS AVAILABLE." TO THE MAXIMUM EXTENT PERMITTED BY LAW, OUR TOTAL LIABILITY RELATING TO THE MEMBERSHIP IS LIMITED TO THE MEMBERSHIP FEES YOU PAID IN THE 12 MONTHS PRECEDING THE CLAIM. NOTHING IN THESE MEMBERSHIP TERMS LIMITS RIGHTS THAT CANNOT BE EXCLUDED UNDER APPLICABLE CONSUMER LAW.
14. Governing Law
These Membership Terms are governed by the laws of the State of Nevada, USA, without regard to conflict-of-law principles. For users in Australia, nothing here limits rights under the Australian Consumer Law (Competition and Consumer Act 2010 (Cth)) that cannot be excluded by contract.
15. Changes to These Membership Terms
We may update these Membership Terms from time to time. We will provide at least 30 days' notice by email before material changes take effect. Continued use of your Membership after the effective date constitutes acceptance of the revised Membership Terms.
16. No Purchase Necessary (Free Method of Entry)
No purchase or paid Membership is necessary to enter the monthly prize draw, and entering for free neither improves nor reduces your chance of winning. Membership entries and free entries are treated equally in each draw.
To enter the monthly prize draw without a Membership, send a request by post that clearly includes your full name, a contact email address, your postal address, and the words "108 Monthly Prize Draw, Free Entry" written on the enclosed card or letter. Mail it to:

Limit one (1) free entry per person per monthly draw period. Each free entry must be posted separately and must be received before the close of the relevant draw period. Entries that are illegible, incomplete, mass-produced, or submitted by automated means are not eligible. Free entrants must meet the same eligibility requirements as members, and the prize draw remains void where prohibited and subject to the availability restrictions in clauses 2 and 8.
